o    Depict people a minimum of 25 years old, substantiated by proper identification, and should reasonably appear to be over 21 years of age 
o    Not depict the act of drinking 
o    Not portray, encourage, or condone drunk driving 
o    Not depict situations where HARD MTN DEW is being consumed excessively, in an irresponsible or reckless way, or in any way illegally. 
o    Not portray persons in a state of intoxication or in any way suggest that intoxication is acceptable conduct. 
o    Not portray or imply illegal activity of any kind. 
o    Not portray nudity, sexual passion, promiscuity, or any other amorous activity. 
o    Not target a person based on their race, gender, or identification.
o    Not employ any symbol, gesture, or cartoon character that is intended to appeal primarily to persons below the legal purchase age. 
o    Not employ any entertainment figure or group that is intended to appeal primarily to persons below the legal purchase age. 
o    Not depict Santa Claus or the Easter Bunny. 
o    Not associate or portray HARD MTN DEW drinking before or during activities which require a high degree of alertness or coordination. 
o    Not contain any lewd or indecent language or images. 
o    Not employ religion or religious themes. 
o    Not disparage competing alcoholic beverages. 
o    Not show littering or otherwise improper disposal of HARD MTN DEW containers, unless the scenes are used clearly to promote anti-littering and/or recycling. 
o    Do not show any trademarks or copyrights other than HARD MTN DEW trademarks or copyrights. This includes but is not limited to clothing, props, and background images. 
o    Not depict any retail establishment.
