Angry Orchard's Green-17 Pack Terms and Conditions

ELIGIBILITY: Angry Orchard® GOLDEN TICKET PROMOTION (the “Promotion”) is open to legal residents of the United States (except Alaska, California, Hawaii, Missouri, New Jersey, Pennsylvania, Texas, Utah, and Vermont) who are at least twenty-one (21) years of age at the time of entry and have an Eligible Cash App Account. An “Eligible Cash App Account” means a Cash App account that has successfully completed identity verification steps and has agreed to the Cash App’s Virtual Currency Terms of Service. Employees (and their immediate families) of The Angry Orchard Cider Company (the “Sponsor”), Give Them Beer, (the “Administrator”) and any of their parents, subsidiaries, affiliates, suppliers, independent contractors, agencies, alcoholic beverage wholesalers and retailers, and any persons living in the same household as such employees are not eligible to participate in the Promotion (cumulatively, the “Promotion Entities”).  Promotion is subject to all applicable federal, state, local laws and regulations and is void where prohibited by law.  The Promotion begins on 3/3/2021 and ends 3/17/2021 (the “Promotion Period”). Square, Inc. (“Cash App”) shall facilitate the distribution of the Prizes but is not involved in the execution of the Promotion.  

 

HOW TO PARTICIPATE: During the Promotion Period, look inside specially marked 17-packs of Angry Orchard® Hard Cider available for purchase via Give Them Beer for a winning golden ticket. If you find a winning golden ticket that states “You found Angry Orchard’s Pot Of Gold…Redeemable in $500 worth of bitcoin!” then you win the prize (subject to eligibility and verification). If you do not receive a winning golden ticket in your 17-pack, then you are not a winner. Only official winning golden tickets from the Angry Orchard Golden Ticket Promotion are eligible. All other winning golden tickets are invalid and void; and use of same may constitute fraud. Additional method of entry for eligible participants in accordance with the terms herein: to enter the Promotion without making a purchase, handprint in blue or black ink on a standard 3 x 5-inch card your full name, complete home address including zip code, email address, and telephone number and mail it to Angry Orchard Golden Ticket Promotion Entry Request, One Design Center Place, Suite 850, Boston, MA 02210 to receive one (1) entry into the Promotion.  No copies, facsimiles or mechanical reproductions will be accepted.  The card must be postmarked during the Promotion Period and be received by no later than 3/17/2021.  Seventeen (17) entries will be selected at random as a winner.  Sponsor will email a prize to each winning entry using the information provided at entry.

Limited one (1) entry per person, regardless of method of entry. Duplicate entries for a single individual will be disqualified.  All entries become the property of the Sponsor.

PRIZE AND ODDS OF WINNING:  Seventeen (17) Total Prizes are available in the Promotion. Each prize winner will receive a piece of Bitcoin valued at $500 through CashApp with an Approximate Retail Value (“ARV”) - $500.  The difference between any stated value and actual value will not be awarded to winner. Prize does not include alcoholic beverages. The random seeding, selection of a winner, and awarding of the prize will be conducted under the supervision of Administrator, an independent organization whose decisions are final and binding in all matters pertaining to this Promotion. No prize substitution will be allowed, except that Sponsor reserves the right to substitute a prize of comparable value if the prize listed is unavailable for any reason.  Odds of winning depend on the number of 17-packs purchased. UNCLAIMED AND FORFEITED PRIZES WILL NOT BE AWARDED.  Unclaimed prizes will not be awarded.  All applicable federal, state, and local taxes on prize are the sole responsibility of the prize winner.  Limit one (1) prize per person/household.   Any Virtual Currency Prize is subject to the Cash App “Conversion Rate” as the then-effective exchange rate for Virtual Currency.

VIRTUAL CURRENCY VALUES CAN FLUCTUATE SUBSTANTIALLY WHICH MAY RESULT IN A TOTAL LOSS OF THE VALUE OF THE VIRTUAL CURRENCY IN YOUR HOSTED BALANCE. CASH APP DOES NOT OWN OR CONTROL ANY OF THE SOFTWARE PROTOCOLS THAT ARE USED IN CONNECTION WITH THE VIRTUAL CURRENCIES PURCHASED, SOLD, OR TRANSFERRED THROUGH THE SERVICES. ACCORDINGLY, CASH APP DISCLAIMS ALL LIABILITY RELATING TO SUCH PROTOCOLS AND ANY PRICE FLUCTUATIONS IN VIRTUAL CURRENCY, AND MAKES NO GUARANTEES REGARDING THE SECURITY, FUNCTIONALITY OR AVAILABILITY OF SUCH PROTOCOLS.

YOU UNDERSTAND THAT IF AN ACCEPTED VIRTUAL CURRENCY IS SUBJECT TO ANY FORKS, IT IS CASH APP’S DISCRETION WHETHER OR NOT TO SUPPORT SUCH FORKED CURRENCY.

PRIZE CLAIMS: All prize claims must be received by 3/31/2021. If received after this date, prize claim is void. For prize verification, email social@angryorchard.com with your name and Cash App Cashtag. If you don’t already have a Cash App Account, visit www.cash.app or visit your App Store and download the Cash App. It is free to download the Cash App and otherwise create a Cash App account. By submitting your information and creating a Cash App account, you will be required to agree to the Cash App terms of service and privacy notice. If you do not agree to the Cash App terms of service and privacy notice, you cannot create a Cash App Account. Prizes will then be fulfilled by the Cash App team directly. Prize claims are subject to eligibility and verification by Sponsor whose decisions are final in all matter relating to this Promotion and are not subject to appeal.  Potential Winners will be required to complete, sign and return an affidavit of eligibility and liability and publicity release (“Winner’s Documents”) within seven (7) days of prize notification.  In the event of noncompliance within this time period, prize will be forfeited without compensation of any kind.  Any prize notification or prize returned to the Sponsor or its agencies as undeliverable will result in disqualification.  Winners will be notified of prize verification of prize claim by email (if provided) at Sponsor’s discretion.  Winners may not substitute or transfer prize, but Sponsor reserves the right to substitute prize with a prize of equal or greater value. This Promotion will be conducted by an independent judging organization whose decisions are final in all matters relating to this Promotion.  Unclaimed prizes or forfeited prizes will not be awarded. Winning tickets are automatically void if they fail to pass anti-fraud detection measures or any winning ticket that is illegible, mutilated, altered, duplicated, tampered with, forged, cut, torn, contains printing, typographical or other errors, distributed where prohibited by law or not obtained legitimately will be void.  If by reason of printing or other error, more prizes are claimed than number set forth in Official Rules, all persons making purportedly valid claims will be included in a random drawing to award the prizes in that category.  No more than advertised number of prizes will be awarded.  IF YOUR SPECIALLY-MARKED PACKAGE DOES NOT CONTAIN A WINNING TICKET CONTAINING A WINNING MESSAGE, YOU ARE NOT A WINNER AND ARE NOT ELIGIBLE FOR A PRIZE.  Liability for winning ticket containing printing or other errors is limited to replacement with another winning ticket until 3/31/2021 or while supplies last, whichever occurs first.  (If supply of winning tickets has been exhausted, Sponsor and its agencies will not have any liability under any legal theory.)  The submission of a prize claim is solely the responsibility of the participant. 

WINNER NOTIFICATION:  Potential prize winner will be notified by Angry Orchard via email and will be required to sign and return an Affidavit of Eligibility and Release of Publicity and Liability (where permitted by law) within seven (7) days of notification. Winner’s age is subject to independent age verification, and if failed, will result in prize forfeiture.  In the event of noncompliance, if the prize winner cannot be reached at the phone number, email address or address on that winner’s entry, or if the prize or prize notification is returned unclaimed or undeliverable for whatever reason beyond the control of Sponsor, that prize will be forfeited, and an alternate winner may be selected only if time permits and in Sponsor’s sole discretion.

GENERAL LIABILITY RELEASE:   Acceptance of a prize constitutes winner’s  permission for Sponsor to use winner’s name, image, likeness, voice, picture, audio and video recordings of, biographical information, statements, and any material based thereon or derived there from, together with any actual or fictional material, or to refrain from so doing, and address (city and state), without the ability to review, for advertising, promoting and/or publicity purposes worldwide and in any and  all forms of media now known or hereafter developed, in perpetuity, without further compensation, where permitted by law.  Entrants agree that the Promotion Entities and Cash App: (a) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Promotion or any Promotion-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (b) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.  Promotion Entities and Cash App are not responsible for incomplete, illegible, misdirected, misprinted, late, or lost prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.

GENERAL TERMS:  Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Promotion, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. 

FORCE MAJEURE:  Sponsor reserves the right to modify, extend, suspend, or terminate the Promotion, in whole or in part, if it determines, in its sole discretion, that the Promotion or any particular Promotion drawing is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Promotion or particular Promotion drawing as contemplated herein.  In the event Sponsor is prevented from awarding prizes or continuing with the Promotion or a particular Promotion drawing as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failures, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court of jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Promotion in its entirety or the affected portion of the Promotion.

 

DISPUTES, ARBITRATION AND CHOICE OF LAW:  Except where prohibited by law, as a condition of participating in this Promotion, entrant agrees to the following: (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office in Boston, MA; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction.  Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Promotion), and entrant further waives all rights to have damages multiplied or increased.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the right and obligation of entrants and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of Massachusetts, USA, without regard to Massachusetts choice of law provisions.

PERSONALLY IDENTIFYING INFORMATION:  Information submitted to Sponsor by any entrant is subject to Sponsor’s Privacy Policy located at www.angryorchard.com. By participating in the Promotion, entrants hereby agree to Sponsor’s collection and usage of their personally identifying information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.
